Abstract

Abstract: 

After the failure of traditional criminal justice based on deterrence in the face of the criminal phenomenon, it was necessary to develop a criminal policy through which the parties to the public lawsuit give a greater role to their will, by adopting consensual procedures that are more rapid in resolving disputes and ending the limit of the public lawsuit, and thus lead to a solution The crisis in the justice sector, in a way that guarantees a shift from compulsive justice to consensual justice

بعد فشل العدالة الجنائية التقليدية المرتكزة على الردع في مواجهة الظاهرة الإجرامية كان من الضروري استحداث سياسة جنائية تعطي من خلالها لأطراف الدعوى العمومية دورا اكبر لإرادتهم ، وذلك من خلال إتباع إجراءات رضائية تعتبر أكثر سرعة في حسم النزاعات وإنهاء حد للدعوى العمومية، وهي بذلك تؤدي إلى حل الأزمة التي عرفها قطاع العدالة بما يضمن التحول من العدالة القهرية إلى العدالة الرضائية

Après l'échec de la justice pénale traditionnelle fondée sur la dissuasion face au phénomène criminel, il a fallu développer une politique pénale à travers laquelle les parties à l'affaire publique donnent un plus grand rôle à leur volonté, par l'adoption de procédures consensuelles plus rapides dans la résolution des litiges et la levée des limites du procès public, et donc conduisent à une solution La crise du secteur de la justice, d'une manière qui garantit le passage de la justice compulsive à la justice consensuelle
